This privacy policy does not apply to any website operated by third parties.

If any term in this policy is unacceptable to you, please do not use the Websites or provide any Personal Information (as defined below). By accessing or using the Websites, you acknowledge this privacy policy. This Privacy Policy does not apply to third-party applications or software that integrate with the Services through the MERGE platform (“Third-Party Services”) or any other third-party products, services, or businesses. In addition, a separate agreement governs the delivery, access, and use of the Services (the “MSA”), including the processing of any data submitted through the Services (“Service Data”). The organization (e.g., your employer or another entity or person) that agreed to the MSA (“Customer”) controls its instance of the Services and any associated Service Data (the “Customer Instance”).

Information MERGE Collects and Receives

We may collect several types of information from and about users of our Websites, including information by which you may be personally identified, such as name, e-mail address, telephone number, geographic location (provided using GPS, Wi-Fi, or similar technology in the device that you use to access our Websites so that we can provide content customized toy our location), background information, or any other information collected on the Websites that is defined as personally identifiable information under applicable law (“Personal Information”); and/or relating to social media, if you provide us your social network identifier (e.g. Facebook, Twitter, Instagram, LinkedIn, etc.), you acknowledge and understand that MERGE may access and use information stored in such service related to your profile or your contacts, including but not limited to photos, emails, birthdays, contacts list (or other publicly available information about your contacts) in order to enhance your communication experience. We collect this information Directly from you when you provide it to us. Automatically as you navigate through the Websites. Information collected automatically may include usage details, IP addresses, connection information, service, and performance-related information, and information collected through cookies, web beacons, and other tracking technologies.

Data Retention

MERGE will retain Service Data following the applicable MSA, Customer’s use of Services functionality, and as required by applicable law. Any data not under applicable MSA will default to the MERGE data policy retention schedule.

MERGE may retain Other Information for as long as necessary for the purposes described in this Privacy Policy. This may include keeping Other Information for the time needed for MERGE to pursue legitimate business interests, conduct audits, comply with (and demonstrate compliance with) legal obligations, resolve disputes, and enforce our agreements. Information Storage

The Websites are intended for users in the United States. Your information will be stored and processed in the United States for statistical analysis. If you use our Websites outside of the United States, please be aware that the United States may have different laws, regulations, and standards regarding data privacy from those in your own country.

How MERGE Shares and Discloses Information

We strive to provide you with choices regarding the Personal Information you provide us. We have created mechanisms to control your information:

Tracking Technologies and Advertising

Do Not Track

Security is critical to MERGE’s mission, and MERGE takes information security seriously. MERGE uses industry-standard technical and organizational measures to protect Information from loss, misuse, and unauthorized access or disclosure. These steps consider the sensitivity of the Information MERGE collects, processes, and stores and the current state of technology. Given the nature of communications and information processing technology, MERGE cannot guarantee that Information in our care will be safe from intrusion by others during transmission through the Internet or while stored on our systems or otherwise. When you click a link to a third-party site, you will leave our site, and MERGE doesn’t control or endorse what is on third-party sites.

The security of your Personal Information is critical to us. We maintain commercially reasonable security safeguards to protect the Personal Information we collect against unauthorized use, disclosure, alteration, or destruction. Notwithstanding the steps we have taken to protect your information, no method of transmission over the Internet or electronic storage method is 100% secure. Age Limitations

In general, our Websites are not intended for children under 13 years of age, and typically MERGE does not knowingly collect or use any Personal Information from children under 13. MERGE DOES NOT CONTROL AND IS NOT RESPONSIBLE FOR WHAT THIRD PARTIES DO IN CONNECTION WITH THEIR WEBSITES OR HOW THEY HANDLE YOUR PERSONAL INFORMATION. To the extent that MERGE’s processing of your Personal Data is subject to the General Data Protection Regulation or applicable laws covering the processing of Personal Data, such as the UK Data Protection Act and the Brazilian General Data Protection Act (Lei Geral de Proteção de Dados), MERGE relies on its legitimate interests, described above, to process your data. MERGE may also process Other Information that constitutes your Data for direct marketing purposes. You have a right to object to MERGE’s use of your Personal Data for this purpose at any time.

MERGE does not sell (as defined in the CCPA) the personal information MERGE collects.
